Found Referral Program Terms

As a member of Found’s “Referral Program” (a “Referrer” ) or a person who participates in this program based on a Referrer’s invitation (a “Referred Customer”), you are subject to Found’s Terms and Conditions and Found’s Privacy Policy (both available on our website located here, as well as the following Referral Program terms and conditions (“Referral Program Terms”). Capitalized Terms not defined here are defined in the Terms of Service.

  • Qualified Referrer.

    • Eligibility. To be eligible for Referral Program, you must have a Found account in good standing and register to participate in the Referral Program by agreeing to these Referral Terms and receiving a Referral Code (described below). You must have a positive non-zero balance on your Found account to be eligible to refer other users through the Found Referral Program. The Referral Program cannot be used by businesses for affiliate lead generation as determined in Found’s sole discretion

    • Referral Code. Upon registration, you will receive a Referral Code. Participants should only use this Referral Program for personal and non-commercial purposes, and the Referral Code should only be shared with personal or professional connections you know and who will appreciate receiving these invitations. Referral Codes should not be published or distributed on any public medium or website. You will be able to access your Referral Code in your Found account profile.

    • Compliance with Law. As a Referrer, you agree to comply with all applicable laws including, but not limited to, the CAN SPAM Act. Any distribution of your Referral Code that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your Account and exclusion from Found’s Referral Program.

  • Referral Rewards

    • General. For each Qualified Referral, both the Referrer and the Referred Customer will receive a credit (“Referral Reward”) applied directly to their Found account. The value of the Referral Reward will be provided on the Found site when you enroll for the Referral Program and receive your Referral Code (as defined below). We may update the amount of Referral Rewards that you are eligible to receive from time to time. Referral Rewards can only be used via the Found Services and are not redeemable for cash. Referrers are eligible to receive multiple Referral Rewards if they make multiple Qualified Referral (defined below) that qualify for a Referral Reward as part of this Referral Program, subject to compliance with the remaining Referral Program Terms.

    • Referral Reward Limitations. Referral Rewards cannot be combined with any other offer or promotional program unless explicitly provided by Found. Presently, each individual Referrer may only obtain a maximum possible Referral Reward of $600.00. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards. Void where prohibited.

  • Qualified Referral.

    • General. A “Qualified Referral” occurs when: (i) a Referrer enters a Referred Customer’s email address through the portal labeled “Invite a freelancer” on the Referrer’s Found account or shares their unique referral code directly with a Referred Customer, (ii) the Referred Customer uses the Referral Code to complete their Found sign-up, and (iii) the Referred Customer has $100 of Eligible Transactions settled in their Found account. Eligible Transactions include purchases made with the Referred Customer’s Found Debit Card, as described below. Upon receiving a Referral Code through this Referral Program as in part specified in this section, the receiving user becomes a Referred Customer.

    • Exclusions and Limitations. For a Qualified Referral to be valid, the Referred Customer: (i) must be a new Found customer who has not had a Found account in the past; and (ii) is not the same person as the Referrer (for example, by using a different email address). The Qualified Referral will be associated with the Referral Code used as part of this promotion.

  • Eligible Transactions.

    • General. Eligible Transactions include certain cash transactions and purchases by the Referred Customer using their Found Card, where the transaction has been settled and not subject to any returns, chargebacks, or other cancellations (“Eligible Transactions”). Any Eligible Transaction will count towards the Referred Customer’s Eligible Transaction requirements unless such transaction is identified as an Ineligible Transaction under this Section.

    • Ineligible Transactions. Any of the following (collectively, “Ineligible Transactions”) will not be counted towards the Referred Customer’s Eligible Transaction requirements: Any transaction involving a transfer from the Referred Customer’s Found Card balance to a digital wallet, including without limitation to a Venmo, PayPal, Stripe, Cash App, or any other digital wallet provider (“Digital Wallet”) including mobile versions and mobile applications of such Digital Wallet. Any purchase or transaction that is reversed including without limitation, by ACH return (as that term is defined under the NACHA Rules) or is cancelled, disputed, reversed, or otherwise rejected for any reason. Eligible Transactions must be from a single Found account, and cannot be combined, accrued, or transferred from multiple Found Accounts (including those of family members) or other sources into a single Found Account.

    • Disclaimer. Found is not responsible for attempted transfers that are not processed for any reason. Found’s team will aim to review Eligible Transactions on a regular basis. Found retains sole discretion in determining which Eligible Transactions are qualified according to these Referral Program Terms.

    • Discrepancies. You must notify us using the “Contact Us” information of any discrepancies in your Found Account within thirty (30) days of the activity date. Requests must include your name, and supporting documentation as we may request.

  • Representations and Warranties. You represent and warrant that you: (i) will not hold yourself out as an agent or otherwise purport to represent or bind Found in any manner; (ii) will not make false or misleading representations with regard to Found services; (iii) will not make representations, warranties, guarantees or negotiate any specific terms with Referred Customers including, without limitation, with respect to the specifications, features or capabilities of Found’s services; and (iv) shall not under any circumstance disparage Found and its products or services.

  • No Combination. Referred Customers may not combine their bonus obtained through their use of the Referral Program with any offer codes or other promotions offered by Found.

  • Right to Terminate Accounts. Found reserves the right to terminate the Account of any Referrer and/or Referred Customer at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Referrer and/or Referred Customer’s conduct to be in violation of these Referral Program Terms.

  • Right to Cancel Program or Change Terms. Found reserves the right to cancel the Referral Program and to revise these Referral Program Terms from time to time. If we make any material changes to these Referral Program Terms, we will notify you of those changes by posting them to the Services or by sending you an e-mail or other notification. If the Referral Program is terminated, any unclaimed Referral Rewards will be forfeited at that time.

  • Contact Us. If for any reason you believe that there is a discrepancy regarding your Referral Reward balance, please contact us at help@found.com. All decisions regarding Referral Reward balances will be final and at Found’s sole discretion.
